A settlement agreement sometimes called a compromise agreement is a legally binding document signed by both employee and employer in order to settle a dispute and any claims that the employee has against them.
The Employee usually receives a full and final settlement at the termination of the contract.
Although employees are not legally obliged to appoint a solicitor to advise on the agreement, as the employer normally pays their legal costs it is sensible to appoint a solicitor to negotiate on their behalf.

I’ve been furloughed but my boss has asked me to work, is this right?

Employees cannot do any work for their own employer and also cannot provide services for or generate revenue for any linked or associated organisation. This also means that your employer cannot transfer you to another company under its control and expect you to work while furloughed. Agency workers cannot perform work for companies linked to the employment agency, including its clients.

Can I make a claim for unfair dismissal?

Normally people can make a claim for unfair dismissal as long as they’ve been in continuous employment for at least two years. The exceptions to this rule are where someone believes they have been discriminated against because of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion and belief, sex or sexual orientation or you’ve been selected for being a whistleblower. Under the Equality Act 2010,  people can claim unfair dismissal on the grounds of discrimination at any stage of your employment.

Is it fair I’ve been turned down for flexible working?

Every employee with 26 weeks of service has a right to ask for flexible working, and every employer must give that request reasonable consideration and a decision within three months unless otherwise agreed. There may be valid reasons why the employer turns down flexible working, in these instances, workers have rights of appeal.

Can I be made redundant while furloughed?

You can still be made redundant while you’re furloughed. If you’re entitled to redundancy pay, it will be calculated using the amount you earned before you were furloughed.

Can I be made redundant while I’m pregnant?

Women can’t be made redundant because they are pregnant, If this happened, they would be able to make a discrimination claim.
